This book addresses key conceptual issues relating to the modern scientific and engineering use of computer simulations. It analyses a broad set of questions, from the nature of computer simulations to their epistemological power, including the many scientific, social and ethics implications of using computer simulations. The book is written in an easily accessible narrative, one that weaves together philosophical questions and scientific technicalities. This article aims to develop a new account of scientific explanation for computer simulations. To this end, two questions are answered: what is the explanatory relation for computer simulations? And what kind of epistemic gain should be expected? For several reasons tailored to the benefits and needs of computer simulations, these questions are better answered within the unificationist model of scientific explanation. Unlike previous efforts in the literature, I submit that the explanatory relation is between the simulation model and the (...) results of the simulation. Abstract This chapter is interested in the epistemology of algorithms. As I intend to approach the topic, this is an issue about epistemic justification. Current approaches to justification emphasize the transparency of algorithms, which entails elucidating their internal mechanisms –such as functions and variables– and demonstrating how (or that) these produce outputs. Thus, the mode of justification through transparency is contingent on what can be shown about the algorithm and, in this sense, is internal to the algorithm. In contrast, I (...) advocate for an externalist epistemology of algorithms that I term computational reliabilism (CR). While I have previously introduced and examined CR in the field of computer simulations ([42, 53, 4]), this chapter extends this reliabilist epistemology to encompass a broader spectrum of algorithms utilized in various scientific disciplines, with a particular emphasis on machine learning applications. At its core, CR posits that an algorithm’s output is justified if it is produced by a reliable algorithm. A reliable algorithm is one that has been specified, coded, used, and maintained utilizing reliability indicators. These reliability indicators stem from formal methods, algorithmic metrics, expert competencies, cultures of research, and other scientific endeavors. The primary aim of this chapter is to delineate the foundations of CR, explicate its operational mechanisms, and outline its potential as an externalist epistemology of algorithms. (shrink)

This study investigates the debt owed by contemporary theological anthropology to the philosophical anthropology of the first half of the twentieth century (considered in its interest in interpersonal character of human identity). It should be recognized that there was a fairly complex relationship between them: sometimes anthropology ended up in some way forgetting theology, sometimes theology was sustained by anthropology and, often, invited to self-criticism. Analyzing «pneumatological» anthropology (and its Christological roots) elaborated by Ferdinand Ebner (1882- 1931) helps theological anthropology (...) not to forget that its method of investigation has to clarify both sides of the analogy between God and man in order to fully integrate the «expressive» meaning of both logics: theo-logic and anthropo-logic. José Blanco White (1775-1841) not only is an active witness of a crucial period in the political life of the Hispanic world on both sides of the Atlantic, but he is also one of the most recognized thinkers and writers of his time. His legacy includes a valuable poetic work. These pages are interested in the theological spirit of one of his most critically admired English sonnets, Night and Death. However, in order to know that own faithful way in which (...) the author expresses in his poem the human questioning for hope in the face of the experience of darkness and death, it is necessary to first penetrate, even if only in a synthetic way, in his understanding and experiencing of the relationship between religion and church, instinct of reason and truth of faith. This leads us to better meet with the background that encourages the poetic expression of his sensitivity towards the beauty of the world and the way in which man can discover in it the call of divine transcendence. This study critically explores, in the light of Christian theology, the singular inter- pretation that François Laruelle (1937) makes of the figure of Christ and his relation- ship with human being. First, we approach the way in which Laruelle’s Christology challenges the abidance between the apostolic narrative and the believing compre- hension about the unity between the Mystery of God and the Event of Jesus Christ. According to Laruelle, Christ has not only raised human freedom beyond the essence and existence (...) of an absolute (and, therefore, the founding axioms of Philosophy that require a prior foundation of the founded); but Christ exhibits the absolute in his finite existence as fully actual. Second, even briefly, we will trace the theological-anthro- pological physiognomy of the Mystery of the Incarnation by means of an inquiry in its soteriological sense. In that sense, the first formal Christian theology is precious: the theology of the Fathers of the Church. So, we intend to point to the way in which Christian faith contributes to the clarification of the singular super-natural quality that defines human nature in its divine connaturality: possibility of always being more and better in the world. We argue that there is no tension between Reid's description of science and his claim that science is based on the principles of common sense. For Reid, science is rooted in common sense since it is based on the idea that fixed laws govern nature. This, however, does not contradict his view that the scientific notions of causation and explanation are fundamentally different from their common sense counterparts. After discussing these points, we dispute with Cobb's and Benbaji's interpretations of Reid's (...) views on causation and explanation. El desencanto causado por la «liquidez» axioló­gica, la demagogia política, el pragmatis­mo económico, la incertidumbre eco­lógica, el narcisismo digital y la uniformidad cultural en los que parece haberse instalado la antropología del trashombre, urge a elaborar un nuevo modelo de orientación vocacional que enseñe a vivir desde la «autotrascendencia» y la «ultimidad personal», o sea, desde la alteridad, la relación, la libertad y el don. Christian existence is permanently faced with the challenge of streng- thening the affective link between the experience of Faith and the truth of Faith. This paper tries to face this challenge through a dialogue between that peculiar human cognitive force that is empathy, and the verification that this is precisely the epistemological focus in which Gospel hermeneutics updates the meaning and salvific transcendence of the Person of Christ (dead and risen) for the witness of any time who meets Him.

Si se identifica libertad con voluntad, se corre el riesgo de tomar a la primera como el único aspecto en que la voluntad se desenvuelve, es decir, considerar el querer como mera actualización de la libertad. Pero la libertad no es más que un aspecto parcial de la voluntad, un aspecto cualitativo del querer, pues el dinamismo de la voluntad procede de su naturaleza y no del hecho de la libertad del acto del querer. La relación entre la inteligencia y (...) la voluntad es lo que caracteriza al acto específicamente humano. Por ello, se impone el análisis de la reciprocidad de influencia de las dos facultades espirituales en su propia unidad viva y funcional, pues si bien el libre albedrío se identifica con el momento de la elección, la libertad recorre todo el acto humano. Puesto que la voluntad tiende naturalmente a lo que supone perfeccionamiento del hombre, la libertad debe fomentar en el caso concreto esa orientación natural de la voluntad, es decir, elevarla a la práctica en la realidad concreta. Que la libertad disponga de la posibilidad de obrar en contra o al margen de ella, es decir, de romper de alguna forma la orientación natural de la voluntad, violentándola y torciéndola, es un defecto y también una forma de esclavitud, pues el hombre cuando obra el mal peca actúa al margen de la razón, conduciéndose como si fuese movido por otro distinto de él mismo. La posibilidad de apartarse del bien no pertenece a la esencia y a la perfección de la libertad, pues ésta consiste en obrar según la razón, impulso propio de acuerdo con su naturaleza. Los dos planos o motivaciones determinantes en que se articula la voluntad, como son el querer natural y necesario y, además, el querer deliberado y libre, son imprescindibles para dar un enfoque correcto al problema de la libertad: pues lo importante es apreciar en la acción libre la parte que se debe a la naturaleza de la voluntad, dándose la libertad únicamente como posibilidad de poner por obra un acto volitivo de acuerdo o no con la orientación natural de aquélla. El interés de esta indagación se centra especialmente en la voluntad deliberada o amor electivo del Bien. Podrá comprobarse la armonía constitutiva que reina entre la intención del fin y la elección de los medios, tema central cuando se estudia la psicología y la filosofía moral de Santo Tomás de Aquino. Las siguientes páginas se deciden a favor de la distinción entre intención del fin -intentio finis- y elección de los medios -electio mediorum-, haciendo partícipe a la voluntad deliberada del último fin en concreto, es decir, de Dios, a través de la intención, salvando así el poder de autodeterminación de la voluntad hacia el fin último en concreto, con lo que se abren las puertas a la conducta moral del hombre. Santo Tomás enfoca el problema de la libertad sin excluir ninguno de los tres planos en los que se articula, como son el plano ontológico, el plano psicológico y el plano moral, ya que el hombre tiene el deber de realizar en cada momento el máximo de su libertad en orden al perfeccionamiento de su ser, en una costosa labor de autocreación y no de caprichosa elección. Así, pues, el mayor ejercicio de libertad humana está en decidirse por su último fin en concreto, es decir, por Dios, a través de una adecuada elección de medios y de una recta intención, pues el hombre, en tanto que criatura, procede de Dios, y en tanto que hombre, tiene su fin último en la glorificación de Dios, en un doble ritmo de procesión y de retorno, poniéndose así de manifiesto el carácter religioso de la moral. Es por ello que el problema de la libertad es, en último término, un problema metafísico, que consiste en el movimiento natural y deliberado de la persona humana hacia su plenitud. (shrink)

We review some results in the theory of non-relativistic quantum unstable systems. We account for the most important definitions of quantum resonances that we identify with unstable quantum systems. Then, we recall the properties and construction of Gamow states as vectors in some extensions of Hilbert spaces, called Rigged Hilbert Spaces. Gamow states account for the purely exponential decaying part of a resonance; the experimental exponential decay for long periods of time physically characterizes a resonance. We briefly discuss one of (...) the most usual models for resonances: the Friedrichs model. Using an algebraic formalism for states and observables, we show that Gamow states cannot be pure states or mixtures from a standard view point. We discuss some additional properties of Gamow states, such as the possibility of obtaining mean values of certain observables on Gamow states. A modification of the time evolution law for the linear space spanned by Gamow shows that some non-commuting observables on this space become commuting for large values of time. We apply Gamow states for a possible explanation of the Loschmidt echo. (shrink)

In this review, we present a rigorous construction of an algebraic method for quantum unstable states, also called Gamow states. A traditional picture associates these states to vectors states called Gamow vectors. However, this has some difficulties. In particular, there is no consistent definition of mean values of observables on Gamow vectors. In this work, we present Gamow states as functionals on algebras in a consistent way. We show that Gamow states are not pure states, in spite of their representation (...) as Gamow vectors. We propose a possible way out to the construction of averages of observables on Gamow states. The formalism is intended to be presented with sufficient mathematical rigor. (shrink)

In this article, I argue that, contrary to scholarly consensus, Antonio Caso draws inspiration from important principles and ideas from Kant’s philosophy in his critique of positivism. I first examine the prima facie textual reasons why someone might believe that Caso and Kant are philosophical enemies. To contradict this notion, I proceed by noting and developing three core ideas that the two share in common. First, Caso and Kant are both ardent critics of dogmatic philosophizing. Second, both Caso and Kant (...) carve out special room for intuition in their respective accounts of cognition, resisting the idea that the understanding has a more prominent role in the formation of knowledge. Third, Kant’s doctrine of aesthetic judgment paves the way for Caso’s de-intellectualized aesthetics. In the end, we see that Kant and Caso are closer to being philosophical friends than enemies. This chapter will explore the reception of Condillac in Argentina from the nineteenth century to the early twentieth century, focusing on two cases. First, the reception by nineteenth-century professors of idéologie (Juan Crisóstomo Lafinur, Juan Manuel Fernández de Agüero, Luis José de la Peña, and Diego Alcorta) that was mediated by the interpretations of Antoine Destutt de Tracy, Pierre Jean Cabanis, and Pierre Laromiguière. Second, the reception in the early twentieth century by José Ingenieros, whose narrative was (...) conditioned by his own political and philosophical agenda. In each case, we can identify different receptions that must be interpreted not only in light of the philosophical concerns of the authors who made them but also in light of the wider cultural and political context in which they emerged. In the first half of the nineteenth century, Condillac was received as a philosopher who integrated the new philosophical canon that would replace the Scholastic canon that had been imposed by the colonial regime. In the early twentieth century, Ingenieros inserted Condillac into a narrative that, starting with Bacon and Locke, culminated in positivism, a current that, in his view, offered the best framework to make Argentina shine in the concert of civilized nations. Para isso, serão analisados três documentários recentes sobre grandes pilotos da categoria, a saber: Jack Brabham, Graham Hill e Juan Manuel Fangio. Utilizando a teorização de Gilles Deleuze acerca da imagem-movimento e seus aspectos semióticos, o objetivo aqui é ver que a cadeia de significação provocada pela reedição de imagens (...) de arquivo provoca a construção de um argumento que ressalta mais o lado humano dos pilotos do que os seus feitos enquanto esportistas consagrados. Conceptual engineering is the method for assessing and improving our concepts. However, little has been written about how best to conceive of concepts for the purposes of conceptual engineering. In this paper, I aim to fill this foundational gap, proceeding in three main steps: First, I propose a methodological framework for evaluating the conduciveness of a given concept of concept for conceptual engineering. Then, I develop a typology that contrasts two competing concepts of concept that can be used in conceptual (...) engineering — namely, the philosophical and psychological ones. Finally, I evaluate these two concepts of concept using the proposed methodological framework and I show that, when it comes to making conceptual engineering an actionable method, the psychological concept of concept outclasses its philosophical counterpart on all counts. This provides a baseline from which the concept of concept can be further improved for the purposes of conceptual engineering. (shrink)

Education is a pillar of buen vivir, the guiding ideal of Ecuador’s 2008 Constitution. In this framework, Ecuador made significant shifts in its education system from 2006 to 2016, the decade of the Citizens’ Revolution. The key buen vivir concepts and processes that framed these shifts were considering education as a right, as a social debt, and as a driver of a more just, knowledge-intensive and clean economy. Resource allocation, general access, learning, and inclusion of structurally marginalized groups showed significant (...) improvement in this decade, along with other key political, economic and social changes, thus making significant advances in the emancipation of society toward buen vivir, and marking elements of how and why advancing this transformation is important. Auty (1993) and Sachs and Warner (1997) reignited the line of argument of the resource curse: the idea that natural resource wealth has negative net effects on the development of nations. However, the result has been found to be highly dependent on the types of variables used to represent natural resource wealth (Brunnschweiler, 2007) and similar questions can raised about variables used to represent being “cursed”. In this paper we pursue the hunt for better variables by looking at the relationship (...) between average income from natural resources per person and a wide array of key development indicators: Adjusted National Net Income, GDP per capita, an aggregate of services and industrialized goods, inequality measured by the Gini index, Poverty, the Human Development Index, the Prosperity Index, the Social Progress Index and the Fragile State Index. We do this on a global scale between 1970 and 2010. On the contrary, we find that natural resource wealth is positively linked to development. We suggest, alternatively, that much of the actual cases where abundant natural resources hurt nations have been cases of common theft by tyrants, often backed by imperial powers. (shrink)

Detractors of Searle’s Chinese Room Argument have arrived at a virtual consensus that the mental properties of the Man performing the computations stipulated by the argument are irrelevant to whether computational cognitive science is true. This paper challenges this virtual consensus to argue for the first of the two main theses of the persons reply, namely, that the mental properties of the Man are what matter. It does this by challenging many of the arguments and conceptions put forth by the (...) systems and logical replies to the Chinese Room, either reducing them to absurdity or showing how they lead, on the contrary, to conclusions the persons reply endorses. The paper bases its position on the Chinese Room Argument on additional philosophical considerations, the foundations of the theory of computation, and theoretical and experimental psychology. The paper purports to show how all these dimensions tend to support the proposed thesis of the persons reply. (shrink)

This paper is a follow-up of the first part of the persons reply to the Chinese Room Argument. The first part claims that the mental properties of the person appearing in that argument are what matter to whether computational cognitive science is true. This paper tries to discern what those mental properties are by applying a series of hypothetical psychological and strengthened Turing tests to the person, and argues that the results support the thesis that the Man performing the computations (...) characteristic of understanding Chinese actually understands Chinese. The supposition that the Man does not understand Chinese has gone virtually unquestioned in this foundational debate. The persons reply acknowledges the intuitive power behind that supposition, but knows that brute intuitions are not epistemically sacrosanct. Like many intuitions humans have had, and later deposed, this intuition does not withstand experimental scrutiny. The second part of the persons reply consequently holds that computational cognitive science is confirmed by the Chinese Room thought experiment. (shrink)

Evânia Reich presents the argument that the veil laws in France—the banning of the full-face coverings in public and the banning of the headscarf in public schools—are consistent with the emancipatory project of French Laïcité. According to this argument, the veils that Muslim women wear are symbols of their oppression, whereas French education seeks to liberate each individual and Laïcité serves as a bulwark against the creeping oppressive influence of religion. Unveiling Muslim women, then, is an act of emancipation. In (...) this essay, I argue that the view of French secularism as an emancipatory project to free women of the oppressive mechanism of the veil is an example of what Marilyn Frye calls the “arrogant eye.” In this essay, I offer an alternative approach on the veil following Frye’s notion of the “loving eye.”. This paper suggests the democratic direction in which the right of freedom of expression should be conceived and applied. In the first two sections it suggests some counter-examples to, and diagnoses of, the libertarian and liberal conceptions of freedom of expression, taking Scanlon (1972) and Scanlon (1979), respectively, to be their chief proponents. The paper suggests that these conceptions cannot take into account clear examples, like fraudulent propaganda, which should not be legal. The democratic conception takes it to heart that (...) the pillars upon which the right of freedom of expression is founded are individual and collective autonomy, the right to know facts of public interest and information necessary for effective democratic control of government. The paper suggests that in a time when private powers seriously threaten these pillars, it is correct for the government to step in to provide the framework in which genuine discussion geared toward fulfilling the objectives of these pillars can take place. Conceptual engineering is the method for assessing and improving our concepts. Some have recently claimed that the implementation of such method in the form of ameliorative projects is truth-driven and should thus be epistemically constrained, ultimately at least (Simion 2018; cf. Podosky 2018). This paper challenges that claim on the assumption of a social constructionist analysis of ideologies, and provides an alternative, pragmatic and cognitive framework for determining the legitimacy of ameliorative conceptual projects overall. The upshot is that one should (...) not ameliorate for the sake of truth or knowledge, in the case of ideologies—at least, not primarily. (shrink)

This paper discusses the logical space of alternative conceptual engineering projects, with a specific focus on (1) the processes, (2) the targets and goals, and (3) the methods of such projects. We present an overview of how these three aspects interact in the contemporary literature and discuss those alternative projects that have yet to be explored based on our suggested typology. We show how choices about each element in a conceptual engineering project constrain the possibilities for the others, thereby giving (...) rise to distinct groupings of possible projects under the banner of conceptual engineering. We conclude with a critical reflection on the potential ethical issues that arise as a result of effectively putting conceptual engineering into practice. (shrink)

The aims of this paper are twofold. First, I offer a new insight into Shepherd’s theory of mind by demonstrating that she distinguishes a threefold ‘Variety of Intellect’, that is, three kinds of minds grouped according to their cognitive limitations. Following Shepherd, I call them (i) minds afflicted with idiocy, (ii) inferior understandings, and (iii) sound understandings. Second, I show how Shepherd’s distinction informs her theory of education. While Shepherd claims that her views serve to improve educational practices, she does (...) not explain how her threefold ‘Variety of intellect’ does so. I argue that Shepherd’s distinction contributes to her aim by providing pedagogues with a more comprehensive grasp of the various cognitive limitations of the people in their care. This work, in English "Struggle for power, organic crisis and judicial independence", has its origin in research academics of the IAEN carried out to provide expert advise to the Inter American Court of Human Rights in the case Quintana and others (Supreme Court of Justice) vs the State of Ecuador. The research is about the nature of the evolution of the ecuadorian state, the dynamics of its institutions, its players, parties, laws, its factors of instability, the way rights have been (...) deployed since the return to democracy in 1979, those who have benefited from neoliberal democracy and those who have paid the costs, and where in all this was the Supreme Court of Justice. The Introduction takes a look at this origin of the work and its intellectual import, provides a brief characterization of the Inter American Sistem of Human Rights Protection, how the Quintana Case fits within it, and an overview of the chapters and their logic. The first chapter analyzes the institutional and sociological factors that have contributed to Ecuador's historically unstable state, based primarily in an antagonistic struggle for power between the Executive and Legislative branches. The second chapter analyzes the economic and political factors that provoked an organic crisis, or crisis of hegemony, between 1997 and 2007 in Ecuador. The third chapter analyzes the evolution of the way in which judges are selected in Europe, the outcomes they have generated, and how they compare with the ecuadorian systems of judge selection in terms of securing judicial independence. The fourth chapter develops a theory of judicial independence in democracy and analyzes how Ecuador measures up to that standard, from when it became a neoliberal minimal democracy in 1981, to when it became a neoliberal false democracy as a consequence of instalation of a system evidently lacking in the people's support under the guise of the 1998 Constitution and its system of judge selection, and the new democratic horizons set by the 2008 Constitution, and the judicial system that springs from it. The thesis develops solutions to two main problems for mental realism. Mental realism is the theory that mental properties, events, and objects exist, with their own set of characters and causal powers. The first problem comes from the philosophy of science, where Psillos proposes a notion of scientific realism that contradicts mental realism, and consequently, if one is to be a scientific realist in the way Psillos recommends, one must reject mental realism. In the process, the thesis defends computational cognitive science from a compelling argument Searle can be seen to endorse but has not put forth in an organized logical manner. A new conception of scientific realism emerges out of this inquiry, integrating the mental into the rest of nature. The second problem for mental realism arises out of non-reductive physicalism- the view that higher-level properties, and in particular mental properties, are irreducible, physically realized, and that physical properties are sufficient non-overdetermining causes of any effect. Kim’s Problem of Causal Exclusion aims to show that the mental, if unreduced, does no causal work. Consequently, given that we should not believe in the existence of properties that do not participate in causation, we would be forced to drop mental realism. A solution is needed. The thesis examines various positions relevant to the debate. Several doctrines of physicalism are explored, rejected, and one is proposed; the thesis shows the way in which Kim’s reductionist position has been constantly inconsistent throughout the years of debate; the thesis argues that trope theory does not compete with a universalist conception of properties to provide a solution; and shows weakness in the Macdonald’s non-reductive monist position and Pereboom’s constitutional coincidence account of mental causation. The thesis suggests that either the premises of Kim’s argument are consistent, and consequently his reductio is logically invalid, or at least one of the premises is false, and therefore the argument is not sound. Consequently, the Problem of Causal Exclusion that Kim claims emerges out of non-reductive physicalism does not force us to reject mental realism. Mental realism lives on. (shrink)

El trabajo consiste en una elucidación de los elementos que conforman el concepto de pena natural (poena naturalis) en el Derecho penal. Se puede caracterizar la pena natural como el daño o sufrimiento que recae sobre el autor de un delito, producto de la comisión del mismo, que debe ser descontado de la pena legal que ha de aplicársele. Si bien existe un mínimo acuerdo sobre esto, tanto en la jurisprudencia como en la doctrina penal se observan serios desacuerdos acerca (...) de los requisitos que se deben cumplir para reconocer que se está frente a una pena natural. Para elucidar los elementos, se utilizará el constructivismo conceptual de Ronald Dworkin, a fin de describir el desacuerdo y sus implicancias, reconocer los elementos principales de la pena natural y justificarlos bajo su mejor luz moral. ABSTRACT This study focuses on the clarification of the conceptual elements of poena naturalis in criminal law settings. The poena naturalis is the damage or suffering that falls on the convict for its commission. This damage must be deducted from the poena forensis to be applied. Although there is a minimum agreement about the concept of poena naturalis, in the jurisprudence and among legal scholars, there are serious disagreements about the elements of poena naturalis. To elucidate the elements, I will adopt Ronald Dworkin’s conceptual constructivism to describe the disagreement and its implications. At last, I will justify the main elements of the poena naturalis by their best moral light. (shrink)

Conceptual engineering is the method for assessing and improving our representational devices. On its ‘broad-spectrum’ version, it is expected to be appropriately applicable to any of our representation-involving cognitive activities, with major consequences for our whole cognitive life. This paper is about the theoretical foundations of conceptual engineering thus characterised. With a view to ensuring the actionability of conceptual engineering as a broad-spectrum method, it addresses the issue of how best to construe the subject matter of conceptual engineering and successively (...) defends the theses that conceptual engineering should be: (i) About concepts, (ii) psychologically theorised, (iii) as multiply realised functional kinds. Thereby, I claim to theoretically secure and justify the maximum scope, flexibility, and impact for the method of conceptual engineering on our representational devices in our whole cognitive life—in other words, a broad-spectrum version of conceptual engineering. Conceptual engineering means to provide a method to assess and improve our concepts working as cognitive devices. But conceptual engineering still lacks an account of what concepts are (as cognitive devices) and of what engineering is (in the case of cognition). And without such prior understanding of its subject matter, or so it is claimed here, conceptual engineering is bound to remain useless, merely operating as a piecemeal approach, with no overall grip on its target domain. The purpose of this (...) programmatic paper is to overcome this knowledge gap by providing some guidelines for developing the theories of concepts and of cognition that will ground the systematic unified framework needed to effectively implement conceptual engineering as a widely applicable method for the cognitive optimization of our conceptual devices. Conceptual engineering is commonly characterized as the method for assessing and improving our representational devices. Little has been said, however, on how best to construe these representational devices—in other words, on what conceptual engineering should be all about. This paper tackles this problem with a basic strategy: First, by presenting a taxonomy of the different possible subject matters for conceptual engineering; then, by comparatively assessing them and selecting the most conducive one with a view to making conceptual engineering an actionable (...) method, that is, a method that can be applied effectively and consistently to specific case studies. This paper considers the question whether the Scottish philosopher Mary Shepherd (1777–1847) endorses a form of nonconceptualism about mental states or their content. While the paper does not arrive at a definitive answer to the question, it paves the way to answering it in the future by demonstrating that there are prima facie promising ways to relate Shepherd to either of the previously mentioned forms of nonconceptualism – although I tentatively conclude that, ultimately, it will be more profitable to consider (...) her views in the context of content nonconceptualism. In arguing the way it does, this paper, then, also aims to bridge the often-lamented gap between the history of philosophy and our contemporary debates. (shrink)

By “epistemic pragmatism” in general I will understand the claim that whether propositions instantiate certain key epistemic properties (such as being known or being justifiably believed) depends not just on factors traditionally recognized as epistemic, but also on pragmatic factors, such as how costly it would be to the subject if the proposition were false. In what follows I consider two varieties of epistemic pragmatism. According to what I shall call moderate epistemic pragmatism, how much evidence we need in favor (...) of a proposition in order to know that the proposition is true depends on our preferences. According to what I shall call extreme epistemic pragmatism, on the other hand, our preferences influence our epistemic position at a more basic level, because they help determine how much justification we actually have in favor of the proposition in question. Simplifying brutally, moderate epistemic pragmatism has it that the more worried we are about a proposition’s being false, the more justification we need in order to know it, whereas extreme epistemic pragmatism has it that the more worried we are about a proposition’s being false, the less justification we have for it. Recently, Fantl and McGrath have presented an interesting argument for moderate epistemic pragmatism, an argument which relies on the principle that (roughly) knowledge is sufficient for action (KA). In this paper I argue that KA, together with a plausible principle about second-order evidence, entails extreme epistemic pragmatism. (shrink)

En la literatura jurídica existe un acuerdo generalizado en que los topes máximos de la pena establecidos la legislación son un límite infranqueable por los jueces. Sin embargo, al abordar el límite mínimo los desacuerdos comienzan a surgir. El objetivo del presente trabajo será el de defender que los mínimos penales, si bien son vinculantes para los jueces, pueden ser dejados de lado cuando las circunstancias particulares del caso lo ameriten. El método empleado será análisis conceptual, más precisamente, al contructivismo (...) interpretativista propuesto por Ronald Dworkin, aplicado al estudio de la jurisprudencia y la doctrina argentina. El resultado final será una justificación – apoyada en la concepción comunicativa del castigo – según la cual los límites mínimos pueden ser dejados de lado en casos concretos y excepcionales, como cuando la culpabilidad del acusado o la lesividad de su conducta se muestran desproporcionadas con el límite mínimo. De esta manera se busca dar respuesta a un problema que se encuentra presente en la práctica jurídica y, sobre todo, brindar herramientas argumentativas para que los operadores judiciales puedan resolver aquellos casos donde este límite se encuentre en discusión. Much of our know-how is acquired through practice: we learn how to cook by cooking, how to write by writing, and how to dance by dancing. As Aristotle argues, however, this kind of learning is puzzling, since engaging in it seems to require possession of the very knowledge one seeks to obtain. After showing how a version of the puzzle arises from a set of attractive principles, I argue that the best solution is to hold that knowledge-how comes in degrees, (...) and through practice a person gradually learns how to do something. However, the two standard accounts of know-how in the literature, intellectualism and anti-intellectualism, cannot properly account for the distinctive way in which know-how is gradually acquired by practice, a process in which conceptual representations and practical abilities are intimately interwoven. Drawing on Gareth Evans's work, I outline an account that may do so, and use this account to distinguish between two forms of learning to explain why skill generally cannot be learnt through testimony, and requires practice. I discuss Turri's puzzle about withholding. I argue that attention to the way in which evidence can justify withholding dissolves the puzzle.

Of all the risks we face in life, ranging from unemployment to old age, early death is among the most tragic and yet most neglected by modern states. Liberal egalitarians might find it easy to dismiss social insurance against early death, but I argue they should not. Early in this paper, I explain why social insurance should include the risk of premature death by replying to four common criticisms. What follows is a case for a novel form of insurance that (...) is more liberal and egalitarian across ages than the status quo. More specifically, I show that granting storable pensions in all life stages - youth, middle and old age - promotes liberty and reduces lifetime inequality. Writers on age group and longevity justice often overlook the extent to which liberal lifetime equality can supply insightful arguments against inequality across ages. These call for a policy that gives each age group the freedom to draw a storable pension. I call that policy "freetirement". (shrink)

El Realismo Científico Estándar sostiene el enfoque metafísico de que el mundo es como es independiente de la mente. Sin embargo, el presente artículo demuestra cómo esta postura es incompatible con todas las teorías no-eliminativistas sobre la mente, lo cual hace que la postura sea inconsistente, incompatible con la ciencia, elimina la consciencia, la intencionalidad, la causación mental y la ética. Se propone una tesis realista alternativa que conserva la idea de que el mundo en general es de la forma (...) que es, independiente de lo que pensemos sobre él, compatible con la mente como parte real del mundo. Este cambio restaura la posibilidad de consistencia, la mente, la consciencia, la intencionalidad, la ciencia y la ética. -/- Standard Scientific Realism holds the metaphysical view that the world is the way it is independent of the mind. However, this paper demonstrates how this view is incompatible with all non-eliminativist theories of mind, leading it to be inconsistent, incompatible with science, and eliminating consciousness, intentionality, mental causation and ethics. An alternative realist thesis is proposed which preserves the idea that generally the world is the way it is independent of what we think of it, compatible with mind as a real part of the world. This reform restores the possibility of consistency, mind, consciousness, intentionality, science and ethics, while at the same time preserving the theoretical advantages over non-realist competitors. Many philosophers endorse “exclusionism”, the view that no instance of relearning qualifies as a case of genuine remembering, and vice versa. Appealing to simulationist, distributed causalist, and trace minimalist theories of remembering, I develop three conditional arguments against exclusionism. First, if simulationism is right to hold that some cases of remembering involve reliance on post-event testimonial information, then remembering does not exclude relearning. Second, if distributed causalism is right to hold that memory traces are promiscuous, then remembering does not exclude (...) relearning. Finally, if trace minimalism is right to hold that vicarious experiences sometimes produce the minimal traces that ground remembering, then remembering does not exclude relearning. While advocates of these theories might incorporate additional conditions designed to accommodate exclusionism, the only reason they can appeal to in favor of doing so is intuition: neither the fundamental components of the theories nor the empirical results on which they are based provide a reason to endorse exclusionism. An investigation of exclusionism thus raises metaphilosophical questions, so far overlooked in philosophy of memory, about the appropriate role of intuition in theorizing about remembering. (shrink)

Malem Seña in “¿Puede las malas personas ser buenos jueces?” analyzed the judicial morality. At first time from a historical analysis, the judges were not required to base their judgments, because they were the mirror of legitimacy and morality of their decisions. With the advent of rationalism and modern State, the sentences should be the foundation. The situation that put the judge person in the background. In this situation, the answer to the question posed in the job would be: "Yes, (...) bad people can be good judges", answer hardly accepted by all. Malem Seña, far from giving a definite answer, ends his work with the insinuation that judges should maintain an image of morality, rather than being morally unimpeachable agents. This situation raises questions about different dimensions of analysis that have been shelved, and in particular try to analyze why this importance takes the image of morality. To do this, from the perspective of the concepts of Slavoj Žižek‘s ideology and fantasy, it will attempt to reach some responses or generate argumentative lines about the importance of the image of morality on morality itself. En el presente trabajo, analizamos el cuento El Inmortal de Borges prestándole principal atención a las situaciones donde se entrelazan, o se tratan sin diferenciar demasiado, cuestiones vinculadas con la animalidad y la divinidad. Sostenemos que esta especie de confusión o falta de precisión al tratar cuestiones que se alejan tanto de la identidad personal y del Yo, como la inmortalidad, no es un elemento casual ni sin fundamento, sino que puede ser analizado filosóficamente adentrándonos la otredad animal. El Inmortal (...) nos manifiesta que la filosofía podría no haber sido lo suficientemente precisa al tratar la otredad, permitiendo que animalidad y divinidad, o más bien ciertas propiedades características de cada una, puedan amalgamarse dentro de los lindes de este concepto. Que el cuento de Borges haga convivir de forma tan característica la inacción con la inmortalidad hace de esta obra un objeto de reflexión obligatorio para todos los interesados en el concepto de otredad. Does self-control require willpower? The question cuts to the heart of a debate about whether self-control is identical with some psychological process internal to the agents or not. Noticeably absent from these debates is systematic evidence about the folk-psychological category of self-control. Here, we present the results of two behavioral studies (N = 296) that indicate the structure of everyday use of the concept. In Study 1, participants rated the degree to which different strategies to respond to motivational conflict exemplify (...) self-control. Participants distinguished between intra-psychic and externally-scaffolded strategies and judged that the former exemplified self-control more than the latter. In Study 2, participants provided various solutions to manage motivational conflict and rated their proposals on effectiveness. Participants produced substantially more intra-psychic strategies, rated them as more effective, and advised them at a higher rate than externally-scaffolded strategies. Taken together, these results suggest that while people recognize a plurality of strategies as genuine instances of self-control, purely internal exercises of self-control are considered more prototypical than their externally-scaffolded counterparts. This implies a hierarchical structure for the folk psychological category of self-control. The concept encompasses a variety of regulatory strategies and organizes these strategies along a hierarchical continuum, with purely intra-psychic strategies at the center and scaffolded strategies in the periphery.
